1. Acceptance of Terms

By accessing or using any EmeraldNetwork service — including our website, Discord bot (EmeraldBot), Minecraft plugin (EmeraldEssentials), or community platform (EmeraldCreative) — you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, do not access or use our services.

These Terms form a legally binding agreement between you and EmeraldNetwork ("we," "us," or "our"). You accept these Terms by using any of our services or by continuing to use them after being notified of any changes.

2. Your Privacy

Your privacy matters to us. Please read our Privacy Policy, which describes the types of data we collect from you, how we use it, and your rights regarding that data. Where processing is based on consent, by agreeing to these Terms you consent to our collection and use of your data as described in the Privacy Policy.

3. Your Content

Many of our services allow you to create, store, or share content — such as messages in our Discord community, configurations in EmeraldEssentials, or creations in EmeraldCreative. You retain ownership of any content you submit ("Your Content"). You are solely responsible for it.

• License to us: By submitting Your Content, you grant EmeraldNetwork a worldwide, non-exclusive, royalty-free license to use, display, store, and distribute it solely to operate and improve our services.
• Sharing with others: If you share Your Content publicly through our services, others may view or interact with it. Do not share content you do not want seen by others.
• Responsibility: You represent that you have all necessary rights to submit Your Content and that it does not violate any law or these Terms.

4. Code of Conduct

When using EmeraldNetwork services, you agree to the following rules:

• Do not use our services for any unlawful purpose or in violation of any regulations.
• Do not harass, bully, threaten, or harm other users through any of our platforms.
• Do not attempt to exploit, reverse-engineer, decompile, or otherwise tamper with our software (including EmeraldBot or EmeraldEssentials) except as permitted by law.
• Do not submit or distribute malware, spam, phishing content, or any material designed to harm systems or deceive users.
• Do not impersonate EmeraldNetwork, IceEmerald, or any other person or entity.
• Do not engage in activity that is fraudulent, false, or misleading.
• Do not attempt to circumvent any technical restrictions or access controls in our services.
• Do not violate or infringe the intellectual property, privacy, or other rights of others.

We reserve the right to remove content or restrict access for any violation of this Code of Conduct, at our sole discretion.

5. Using Our Services

EmeraldNetwork provides the following services, each subject to their own additional conditions where applicable:

• EmeraldBot (Discord Bot): A Discord bot offering moderation, utilities, and community features. You may use EmeraldBot on your Discord server in accordance with both these Terms and Discord's own Terms of Service.
• EmeraldEssentials Plugin (Minecraft): A Minecraft server plugin. You may install and use this plugin on servers you own or manage, in accordance with Minecraft's End User License Agreement.
• EmeraldCreative: A creative application for digital projects. Usage is subject to these Terms and any in-app guidelines.
• EmeraldNetwork Website: Our website provides information, documentation, and access to the above services.

You are responsible for your own hardware, internet connection, and any third-party software (e.g., Discord, Minecraft) required to access our services.

6. Third-Party Services

Our services may integrate with or link to third-party platforms such as Discord and Minecraft. We are not responsible for the content, policies, or practices of any third-party services. Your use of those platforms is governed by their respective terms and policies.

Any third-party services connected to EmeraldNetwork services are provided "as-is" and we make no warranties regarding their availability or reliability.

7. Service Availability

We strive to keep EmeraldNetwork services available and reliable. However, we do not guarantee uninterrupted or error-free operation. We may temporarily suspend access to our services for maintenance, updates, or other operational reasons, with or without prior notice.

8. Updates to Services & These Terms

We may update, modify, or discontinue features of our services at any time. We will try to provide reasonable advance notice for significant changes.

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of our services after any changes constitutes your acceptance of the new Terms.

9. Intellectual Property

All content, code, designs, logos, and branding related to EmeraldNetwork — including EmeraldBot, EmeraldEssentials, and EmeraldCreative — are owned by EmeraldNetwork / IceEmerald or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our services for their intended purposes. You may not copy, reproduce, distribute, modify, or create derivative works of our content or software without express written permission.

10. Disclaimers

Our services are provided on an "as is" and "as available" basis, without warranties of any kind — whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

To the fullest extent permitted by law, EmeraldNetwork and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or service interruption — arising out of or in connection with your use of, or inability to use, our services.

Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid (if any) to use the applicable service in the 12 months prior to the claim.

12. Termination

We reserve the right to suspend or terminate your access to any or all EmeraldNetwork services at any time, with or without notice, for conduct that we determine in our sole discretion to violate these Terms or is harmful to other users, us, or third parties.

You may stop using our services at any time. Termination does not affect rights or obligations that arose before termination.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in a manner consistent with applicable law.
